Terms of Service

These Terms of Service (“Terms”) are a binding agreement between Brand Anvil, LLC, doing business as ScapeMaker (“ScapeMaker,” “we,” “us,” or “our”), and the person or organization that accesses or uses our websites, software, WordPress plugin, AI landscape-design experience, subscriptions, or implementation services (collectively, the “Services”). By creating an account, purchasing or using the Services, or permitting the Services to be used on your website, you agree to these Terms. If you use the Services for a company, you represent that you have authority to bind that company.

1. The Services

ScapeMaker provides landscape contractors with a branded, AI-powered lead-generation and sales-qualification experience. Homeowners can submit property photos and project preferences, and the Services may produce AI analysis, conceptual visualizations, preliminary materials or scope information, estimated investment ranges, and design booklets. Features, usage allowances, and availability may vary by plan.

ScapeMaker is not a licensed landscape architecture, engineering, surveying, permitting, construction-document, or estimating service. Outputs are conceptual and preliminary. They are not final plans, specifications, bids, guarantees, or professional advice.

2. Eligibility and Accounts

  • You must be at least 18 years old and able to enter a binding contract.
  • You must provide accurate account and business information and keep it current.
  • You are responsible for all activity under your account and for maintaining the confidentiality of credentials.
  • You must promptly notify us at info@scapemaker.ai if you suspect unauthorized access.

3. Contractor Responsibilities

Contractor customers are responsible for their business relationship with homeowners and for all decisions, representations, estimates, proposals, contracts, work, and communications arising from a lead. You must:

  • Use the Services only for lawful business purposes.
  • Maintain accurate services, pricing rules, branding, approved domains, and contact information.
  • Provide legally required notices and obtain appropriate permissions before collecting or using homeowner information.
  • Independently review every AI output, concept, scope, material suggestion, and estimated range before relying on or sharing it.
  • Confirm field conditions, dimensions, utilities, drainage, grading, codes, permits, product availability, and professional requirements.
  • Use qualified professionals where landscape architecture, engineering, surveying, permitting, or other licensed services are required.

4. Acceptable Use

You may not misuse the Services, including by:

  • Uploading content you do not have the right to use or that violates privacy, intellectual-property, or other rights.
  • Submitting unlawful, deceptive, harmful, abusive, discriminatory, or malicious content.
  • Attempting to access another customer’s data, bypass authentication, defeat usage controls, probe security, reverse engineer protected portions of the Services, or interfere with operation.
  • Using automated means to overload, scrape, or exploit the Services without written permission.
  • Reselling, sublicensing, or representing ScapeMaker as your own software except through authorized branded use.
  • Using generated content to mislead a homeowner about final design, price, feasibility, or guaranteed project results.

5. Customer Content and Permissions

You retain ownership of content you lawfully submit, including business branding and property photos. You grant ScapeMaker a worldwide, nonexclusive license to host, store, reproduce, process, modify, transmit, and display that content only as reasonably necessary to provide, secure, support, and improve the Services and comply with law.

You represent that you have all rights and permissions necessary for submitted content and for ScapeMaker to process it as described. You are responsible for responding to homeowner requests concerning information you independently control.

6. AI-Generated Content

AI output may be inaccurate, incomplete, unrealistic, inconsistent, or similar to output generated for others. You must evaluate it for your intended use. ScapeMaker does not guarantee that plants, materials, features, prices, dimensions, site conditions, or regulatory assumptions shown or described are correct, available, buildable, safe, or suitable. Please review the separate AI Design Disclaimer, which is incorporated into these Terms.

7. Fees, Billing, and Taxes

  • Subscription prices, billing intervals, included usage, and one-time service fees are disclosed at checkout or in an order form.
  • Subscriptions renew automatically for successive billing periods until canceled.
  • You authorize our payment providers to charge the payment method associated with your order.
  • You are responsible for applicable taxes, except taxes based on our net income.
  • Failed or overdue payments may result in a grace period, suspension, or loss of access.
  • Usage beyond plan allowances may be limited or billed only as disclosed for the applicable plan.

8. Plan Changes, Cancellation, and Refunds

You may cancel a subscription through the available account or billing controls or by contacting us. Cancellation stops future renewals but does not immediately terminate a paid subscription; access continues through the end of the current paid billing period. Downgrades take effect at the next billing cycle unless stated otherwise. Subscription charges are nonrefundable after billing except where required by law or expressly approved by ScapeMaker.

An implementation-service payment may be refunded if you cancel before implementation work begins. Once work has begun, the implementation fee is nonrefundable except where required by law or expressly agreed in writing. Additional details appear in our Refund & Cancellation Policy, which is incorporated into these Terms.

9. Suspension and Termination

We may suspend or terminate access when reasonably necessary to address nonpayment, security risks, unlawful or abusive conduct, material breach, harm to the Services or others, or legal requirements. We will use reasonable efforts to provide notice when appropriate. Following cancellation, contractor account data is retained for 90 days before becoming eligible for permanent deletion, subject to legal, tax, accounting, fraud-prevention, backup, and dispute-resolution needs.

10. Intellectual Property

ScapeMaker and its licensors retain all rights in the Services, software, design, documentation, trademarks, and other materials, excluding customer content. Subject to these Terms and payment of applicable fees, we grant you a limited, nonexclusive, nontransferable, revocable right to use the Services for your internal business operations and authorized website integration.

11. Third-Party Services

The Services rely on third-party hosting, storage, authentication, AI, email, payment, bot-protection, and other providers. Your use may also be subject to those providers’ terms. We are not responsible for third-party services outside our reasonable control.

12. Service Changes and Availability

We may update, improve, discontinue, or change features, subject to applicable law and any material commitments in an order form. We do not promise uninterrupted or error-free operation. Maintenance, provider outages, internet failures, security events, and circumstances outside our control may affect availability.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SCAPEMAKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RESULTS. WE DO NOT WARRANT THAT AI OUTPUT, LEADS, ESTIMATES, CONVERSION RATES, REVENUE, PROJECT OUTCOMES, OR THIRD-PARTY SERVICES WILL MEET YOUR EXPECTATIONS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAPEMAKER AND BRAND ANVIL, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR COSTS OF SUBSTITUTE SERVICES. OUR TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO SCAPEMAKER DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED.

15. Indemnification

You agree to defend, indemnify, and hold harmless Brand Anvil, LLC, ScapeMaker, and their owners, personnel, and service providers from claims, losses, liabilities, damages, and reasonable costs arising from your customer content, your business or landscape services, your violation of these Terms or law, or your infringement of another person’s rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in the state or federal courts with jurisdiction over Lewis County, Missouri, and each party consents to that venue and jurisdiction. Before filing a claim, the parties agree to make a good-faith effort to resolve the dispute by written notice and discussion for at least 30 days.

17. Changes to These Terms

We may update these Terms. We will post the revised version and update the date above. If a change materially affects existing customers, we will provide additional notice when required. Continued use after the effective date constitutes acceptance of the updated Terms.

18. General

These Terms and incorporated policies are the entire agreement concerning the Services unless an executed order form or written agreement states otherwise. If any provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a business reorganization or transfer. Electronic notices and records satisfy writing requirements where permitted by law.
